POI Genie – website, software and membership terms & conditions

These terms and conditions govern your use of the POI Genie website, POI Creator and POI databases in whatever format this may take; by using our website, POI Creator and POI databases, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, do not use this website.

(2) Intellectual property rights

We own sole intellectual property rights in the website, the software, the databases and any other material on the website. Subject to the license below, all our intellectual property rights are reserved.

(3) License to use website

You may use the POI Genie website, POI Creator and POI databases provided that:

(i) you do not republish material from this website (including republication on another website), or reproduce or store material from this website in any public or private electronic retrieval system;

(ii) You may distribute your created POI files freely. You may NOT share, post to another website or distribute in any format ANY POI file/s from our databases which were not created by you. You must not reproduce, duplicate, copy, sell, resell, or otherwise exploit our website or material on our website for a commercial purpose, without our express written consent. We use digital signatures within our POI files and will rigorously defend all breaches of our copyright to the full extent of the law.

(iii) POI Genie retains full copyright to all POI files created using our POI Creator. The exception to this is the individual logo used as the icon where the standard POI Genie is not used. Copyright in this instance will always remain with the copyright holder.

(4) Limitations of liability

Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we not commit to ensuring that the website remains available or that the material on this website is kept up-to-date.

In order to use this site you must agree to be legally bound and to abide by the terms and to indemnify and hold POI Genie and it’s owners harmless from all alleged or actual damages, claims and expenses relating to any warrant, guarantee or representations made by individual merchants or linked sites. This also includes, without limitation, attorney's fees. The use of this site for any reason is deemed to be an agreement of this condition. We advise that all members and users and of the site verify the contents and source of the information before making any decisions or otherwise relying on any information.

It is a condition of use of the site and the materials in it that use is at the user's own risk. We give no representation or warranty as to the accuracy of the content of the site or the databases and assume no responsibility for errors or omissions in them. We disclaim all liability in respect of such information and its provision. Access to certain areas of our website is restricted to members only. The current fees for membership are ?2.95 per calendar month. We reserve the right to review this amount at any time. You will be informed by email at least 14 days before any price change. It is your responsibility to ensure your current email address is registered against your membership.We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion.

If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential. You accept responsibility for all activities that occur under your user ID or password.

We may disable your user ID and password at our sole discretion or if you breach any of the policies or terms governing your use of our website or any other contractual obligation you owe to us

You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website.

You must not use our website in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use our website for any purposes related to marketing without our express written consent.

You must not use our forums to publish links to other sites without our express permission. ALL posts containing URL links will be deleted.

You must not use our website to copy, publish or send material which is illegal or unlawful, or material which could give rise to legal action under English and other applicable law. All material you copy, publish or send via our website must not be defamatory, obscene, indecent, hateful, discriminatory or inflammatory; such material must not infringe any person's intellectual property rights or rights of confidence, impinge upon any person's privacy, or constitute incitement to commit a crime[; further, material must not be misleading, deceptive, sexually explicit, threatening, abusive, harassing or menacing.]
